Overview & Acceptance of Terms

By accessing or using the Difinery website (“Site”), you agree to these Terms & Conditions. If you do not agree, please discontinue use of the Site.

You must be 18 years or older to make a purchase.

Use of this Site is permitted solely for personal, non-commercial purposes.

Your use of the Site is also governed by our:

  • Return & Refund Policy

  • Shipping Policy

  • Warranty & Care Policy

These documents are incorporated into these Terms.

Product Information, Pricing & Payment

All prices are listed in U.S. dollars (USD).

International customers: Your bank or payment provider may charge currency conversion or foreign transaction fees. Any customs duties, taxes, or import fees are your responsibility.

Difinery never stores full credit card numbers. By placing an order, you authorize Difinery and its payment processors to charge your selected payment method.

Order Accuracy & Cancellations

We reserve the right to cancel orders due to pricing errors, stock availability, suspected fraud, or incomplete information. If we cancel an order, any collected payment will be fully refunded.

Made-to-Order Production & Shipping

Made-to-Order Craftsmanship

All Difinery pieces are made to order to minimize waste and ensure quality. Production begins once your order is completed and takes approximately 5–7 business days.

Shipping

We ship worldwide using trusted carriers.

Estimated delivery times after production:

  • United States: 7–10 business days

  • International: 10–21 business days

These are estimates, not guarantees.

Once shipped, you will receive a tracking link by email. Tracking updates may take up to 48 hours to activate.

Customer Responsibility

Difinery is not responsible for:

  • Incorrect or incomplete addresses provided by the customer

  • Packages marked “delivered” by the carrier but not received

  • Delays caused by customs, carriers, or events beyond our control

Refused or unclaimed international shipments: Shipping costs and return fees will be deducted from the refund.

Returns & Refunds

All returns are governed by our Return & Refund Policy.

Key summary:

  • Returns accepted within 30 days of delivery

  • Items must be unworn, undamaged, and in original packaging

  • Custom, engraved, or personalized pieces are final sale

  • Customer is responsible for return shipping

  • Refund issued after inspection to the original payment method

If a ring does not fit, please refer to the Resizing Policy (Section 5) before initiating a return.

Resizing Policy

We offer one complimentary resizing for eligible ring designs within 60 days of delivery.

Eligibility

  • Applies to rings that can safely be resized

  • Excludes eternity bands, custom pieces, or designs that structurally cannot be resized

Process

  • Email support@difinery.com with your order number and new size

  • Ship the ring to us using a tracked, insured carrier (your cost)

  • We resize and return it within 10–14 business days

  • Difinery covers return shipping

Additional resizing beyond the complimentary service is available at fair, transparent cost.

Warranty & After-Care

Manufacturing Defect Warranty

Difinery provides a 1-year limited warranty covering defects in materials or craftsmanship.

Covered:

  • Setting or prong failure

  • Chain, clasp, or link breakage due to manufacturing

  • Metal defects

Not Covered:

  • Normal wear (scratches, patina)

  • Loss or theft

  • Exposure to chemicals, accident, improper storage

  • Third-party repairs or alterations

  • Faded engravings

  • Damage outside normal use

If a defect is confirmed, Difinery will repair or replace the piece at no cost. If discontinued, we will offer an equivalent replacement or a full refund.

Complimentary Polishing & Cleaning

For the first year:

  • Customer pays to ship the item to Difinery

  • Difinery covers return shipping

  • Service includes cleaning and polishing (not repairs)

Honest Warranty Statement

We do not offer “lifetime warranties.” We believe quality comes from craftsmanship, not marketing terms.

We focus on:

  • 100% recycled gold

  • NYC craftsmanship

  • Transparent repair pricing

If something goes wrong, we provide honest options—no gimmicks.

Gift Cards

  • Non-refundable and non-reloadable

  • Cannot be exchanged for cash (unless required by law)

  • May be combined with other gift cards

Product Variations & Display Disclaimer

Difinery pieces are handcrafted. Natural variations in finish, texture, and appearance are inherent and not defects.

Colors may appear differently due to screen settings, lighting, and device displays.

Privacy & Data Protection

Your use of the Site is governed by our Privacy Policy, which explains how we collect, use, and protect your data.

User-Generated Content (UGC)

If you publicly tag Difinery or share content featuring our products, you grant us permission to re-share this content on:

  • Our website

  • Social media

  • Email newsletters

You may request removal at any time. This permission does not transfer ownership of your content.

Acceptable Use

You agree not to:

  • Use the Site for unlawful or fraudulent activity

  • Attempt to gain unauthorized access to the Site or servers

  • Scrape, copy, or harvest data

  • Interfere with the Site’s security or functionality

  • Misrepresent your identity or payment information

Violation may result in account suspension or refusal of service.

Termination of Use

Difinery may suspend or terminate your access to the Site at any time if:

  • You violate these Terms

  • Fraud or misuse is suspected

  • Required by law

You remain responsible for all orders placed before termination.

Limitation of Liability

To the fullest extent permitted by law, Difinery is not liable for indirect, incidental, or consequential damages, including loss of profit, data, or goodwill.

This limitation does not apply to:

  • Gross negligence

  • Willful misconduct

  • Situations where limitations are legally prohibited

Our total liability will not exceed the purchase price of the product.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York.

Any disputes will be resolved in the state or federal courts of New York County, NY.

Force Majeure

Difinery is not responsible for delays or failures caused by events beyond our control, including:

  • Natural disasters

  • Supply chain disruptions

  • Illness or pandemics

  • Transportation failures

  • Acts of government

Entire Agreement

These Terms constitute the entire agreement between you and Difinery and supersede all prior communications.

No Waiver

If we fail to enforce a provision in these Terms, that does not constitute a waiver of our right to enforce it later.

Updates to These Terms

We may update these Terms periodically. The “Last Updated” date will reflect all changes. Continued use of the Site means you accept the updated Terms.
